This Safety Disclaimer & Risk Notice applies to all products sold by Float Co. (“Float Co.”, “we”, “us”, “our”) through our website and any associated sales channels.

By purchasing or using any Float Co. product, you acknowledge and agree to the terms below.

1. Not Life-Saving Devices

All products sold by Float Co. – including but not limited to inflatable boats, water toys, water propellors, scooters and accessories – are:

• Designed for recreational use only

• Intended to be used as leisure products / toys

• Not designed, certified or marketed as:

  • Life-saving devices

  • Personal flotation devices (PFDs)

  • Life jackets, rescue equipment or safety gear

Important: Float Co. products must not be relied upon to prevent drowning, injury or death.

You must always use appropriate approved life jackets / PFDs and safety gear as required by your local maritime, boating or water-safety regulations.

2. Inherent Risks & Assumption of Risk

Use of any water-related equipment involves inherent risks, including but not limited to:

• Drowning or near drowning

• Impact or collision injuries

• Hypothermia or environmental exposure

• Equipment failure, misuse, or incorrect setup

• Personal injury, property damage or death

By purchasing or using Float Co. products, you:

• Understand and acknowledge these risks

• Choose to use the products at your own risk

• Accept full responsibility for the way the products are assembled, maintained and used

Float Co. has no control over how, where or under what conditions our products are used once they leave our warehouse.

3. Safe Use, Supervision & Local Laws

You are responsible for ensuring:

• Proper supervision of children and inexperienced users at all times in, on or near water

• All users comply with local laws and regulations, including:

  • Boating and marine safety rules

  • Life jacket / PFD requirements

  • Age and licence restrictions for powered watercraft

• Products are:

  • Used only in appropriate conditions (weather, waves, currents, depth)

  • Set up, inflated, assembled and maintained according to all instructions and warnings provided by Float Co. and the product manufacturer

Never use Float Co. products:

• Under the influence of alcohol or drugs

• Beyond the recommended weight limits, capacity or intended use

• In unsafe weather or water conditions

4. No Professional Advice

Any information on our website, social media, product pages or marketing materials (including tips, videos or demonstrations) is provided for general informational and promotional purposes only.

• It is not professional safety, legal or technical advice.

• You should always follow instructions from qualified water-safety professionals, local authorities and the manufacturer’s manuals.

5. Limitation of Responsibility (Subject to Law)

To the maximum extent permitted by applicable law:

• Float Co. is not responsible for:

  • Misuse, abuse, or modification of any product

  • Failure to use appropriate life-saving equipment (such as certified life jackets / PFDs)

  • Failure to supervise children or inexperienced users

  • Use of products in unsafe conditions or in breach of local laws

• You agree that Float Co. will not be liable for any loss, damage, injury or death arising from:

  • Your use or misuse of the products

  • Your failure to comply with safety instructions

  • Your failure to comply with local water-safety or boating regulations

However: Nothing in this disclaimer is intended to exclude, restrict or modify any non-excludable rights or guarantees you may have under Australian Consumer Law or other mandatory consumer protection laws, nor to exclude liability where such exclusion is prohibited by law.

6. Australian Consumer Law & Mandatory Rights

If you are an Australian consumer, you may have rights under the Australian Consumer Law (ACL) (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), including rights in relation to:

• Products that are not of acceptable quality

• Products that are not fit for purpose

• Products that do not match their description

Those rights cannot be excluded. Our Terms of Service, Returns Policy and this Disclaimer operate in addition to, not instead of, your rights under the ACL.

Where our liability under the ACL can legally be limited, our liability is limited to the repair, replacement or refund of the product, at our discretion, as described in our [Returns & Refund Policy].

7. No Guarantee of Safety

Even when used correctly and with all recommended safety gear:

• No water activity is ever “risk free”

• No Float Co. product can guarantee your safety or prevent drowning, injury or death

You are responsible for:

• Using good judgment

• Assessing water and weather conditions

• Following all relevant laws and safety guidance

• Ensuring all users are competent, supervised and appropriately equipped

8. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Float Co., its owners, employees, contractors and affiliates from any claims, demands, losses or damages (including legal costs) arising out of or related to:

• Your misuse of any Float Co. product

• Your breach of this Disclaimer or our Terms of Service

• Your failure to comply with local laws or safety regulations

9. Relationship with Other Policies

This Safety Disclaimer & Risk Notice should be read together with:

• Our Terms of Service

• Our Returns & Refund Policy

• Our Shipping Policy

• Our Privacy Policy

If there is any inconsistency between this Disclaimer and those documents, the wording that is most compliant with applicable law will apply.
